How New Jersey Courts Decide Alimony

In New Jersey, courts must evaluate 11 specific factors to determine alimony:

  1. Parties’ incomes and lifestyle: Courts must assess earnings and the standard of living during the marriage.
  2. Marriage duration: Longer marriages might lead to more substantial alimony.
  3. Health and education: The earning capacity of each spouse can be affected by health and education levels.
  4. Equitable property distribution: Courts consider the financial impact of dividing marital property.
  5. Need and ability to pay: If one spouse needs support, can the other provide it?
  6. Parental responsibilities: A spouse’s earning potential can be impacted by child care.
  7. Education/training for employment: Courts assess the need for education or training for the spouse seeking alimony to become self-sufficient.
  8. Contributions to the marriage: Alimony amounts often recognize financial and non-financial contributions of each spouse, including career or education sacrifices.
  9. Tax implications of alimony: In New Jersey, laws have changed determining if alimony is taxable for the payee or a tax credit for the payor, so the court may examine how alimony affects each party’s taxes.
  10. Age and health: Older or less healthy individuals may receive more favorable alimony terms.
  11. Pre-existing agreements: Prenuptial agreements and other arrangements regarding property distribution can impact alimony determinations.

These guidelines ensure courts make balanced decisions on alimony, factoring in each party’s circumstances and contributions to the marriage.

What Types Of Alimony Are Available In New Jersey?

Some of the questions an alimony court will ask: Is one of the parties self-employed? Did the marriage last just a few years, or did it last for decades? What are the true incomes of the parties? Our attorneys can assess whether you should pursue permanent, rehabilitative or limited duration alimony:

  • Permanent alimony: This type of alimony applies to long-term marriages where there is a disparity of income between the parties.
  • Rehabilitative alimony: The goal with rehabilitative alimony is to support the nonincome-earning spouse until he or she is self-supporting. This may include providing financial support so that a spouse can go to school for the training she or he needs to be self-supporting. Rehabilitative alimony is temporary.
  • Limited duration alimony: Limited duration alimony is for shorter term marriages where there is disparity of income but where the supported spouse has enough education, skills or training to become self-supporting. Alimony is paid at a specific amount for a specific number of years.

Each type of alimony is tailored to the specific circumstances of the marriage, ensuring fairness and support during the transition to post-divorce life.
